Labor legislation provides for the certification of an employee in order to establish his compliance (non-compliance) with the position held (work performed) . The procedure for conducting certification is established by regulatory legal acts containing standards labor law, or local regulations in force at the employer. Such regulations reflect the specifics of employee certification, taking into account the specifics of work activity and the conditions for its implementation. The latter fully applies to the certification of teaching staff of organizations carrying out educational activities.

In accordance with the Federal Law of December 29, 2012 No. 273-FZ “On Education in Russian Federation"(as amended on July 21, 2014; hereinafter referred to as Federal Law No. 273-FZ), teaching staff undergo certification for compliance with the position held and in order to establish their qualification category. Order of the Ministry of Education and Science of the Russian Federation dated 04/07/2014 No. 276 (hereinafter referred to as Order No. 276) approved a new Procedure for the certification of teaching staff of organizations engaged in educational activities (hereinafter referred to as the Procedure), which defines the general requirements for certification, as well as its features carried out for the purpose of confirming the compliance of a teaching worker with the position held and for the purpose of establishing a qualification category for a teaching worker.

The Procedure applies to the certification of teaching staff holding positions named in subsection 2 of Section I of the nomenclature of positions for managers and teaching staff of educational organizations (approved by Decree of the Government of the Russian Federation dated 08.08.2013 No. 678 “On approval of the nomenclature of positions of teaching staff of organizations providing educational activities, positions of heads of educational organizations"), including in cases where positions are filled part-time in the same or another organization, as well as by combining positions along with work in the same organization, determined by the employment contract (paragraph 2, paragraph 1 of section 1 Order).

According to clause 3 of section 1 of the Procedure main tasks of certification are:

  • stimulation of targeted, continuous improvement of the level of qualifications of teaching staff, their methodological culture, professional and personal growth;
  • determining the need to improve the qualifications of teaching staff;
  • increasing efficiency and quality pedagogical activity;
  • identifying prospects for using the potential capabilities of teaching staff;
  • taking into account the requirements of federal state educational standards for personnel conditions for implementation educational programs when forming the personnel of organizations;
  • ensuring differentiation of wages for teaching staff, taking into account the established qualification category and the volume of their teaching (pedagogical) work.

Basic principles conducting certification: collegiality, transparency, openness, ensuring an objective attitude towards teaching staff, inadmissibility of discrimination during certification (clause 4, section I of the Procedure).

Certification in order to confirm the compliance of a teaching worker with the position held is mandatory for the latter and is carried out, with some exceptions, every five years, and certification in order to establish a qualification category for a teaching worker, on the contrary, is carried out at the request of the relevant employee (see Parts 1-2 of Art. 49 Federal Law No. 273, clause 5 of section II and clause 24 of section III of the Procedure).

In order to confirm suitability for the position held The following teaching staff do not pass certification(Clause 22 of Section II of the Procedure):

  • having qualification categories;
  • those who have worked in their position for less than two years in the organization in which the certification is carried out;
  • pregnant women;
  • women on maternity leave;
  • persons on parental leave until the child reaches the age of three;
  • absent from work for more than four months in a row due to illness.

Note:

Certification of teaching staff provided for in subparagraphs “d” and “e” is allowed no earlier than two years after their return from the specified leaves. Certification of teaching staff provided for in subparagraph “e” is allowed no earlier than one year after their return to work.

The local regulations in force at the employer may determine other categories of teaching staff, the certification of which is organized in terms different from those provided for by Order No. 276, for example, persons on leave in connection with the adoption of a child (Article 257 of the Labor Code of the Russian Federation), persons those on long-term vacation (subclause 4, clause 5, article 47 of Federal Law No. 273), etc.

Features of certification carried out to confirm the suitability of a teaching employee for the position held

To carry out certification in an educational organization, a special certifying commission. On its formation, the employer issues an order (instruction), which approves the personal composition of the certification commission: chairman, deputy chairman, secretary and members of the commission) and, if necessary, regulations on the commission, regulations of the commission, etc.

The Employer also issues an appropriate order (instruction) on certification, which determines the personnel of teaching staff subject to certification, the certification schedule, and, if necessary, other issues regarding the organization of certification activities.

Not less than 30 days Before the date stipulated by the certification schedule, each teaching worker subject to certification must be familiarized with the order (instruction) against signature. For each teaching staff, the employer submits to the certification commission in advance performance, containing information about the teaching staff:

  • last name, first name, patronymic (if available);
  • name of the position as of the date of certification;
  • date of conclusion of the employment contract for this position;
  • level of education and (or) qualifications in specialty or area of ​​training;
  • information on obtaining additional professional education in the profile of teaching activity;
  • results of previous certifications (if any);
  • motivated comprehensive and objective assessment of professional, business qualities and results professional activity pedagogical worker for implementation labor responsibilities assigned to him by the employment contract (clause 11, section II of the Procedure).

No later than 30 days before the scheduled date of certification the employer is obliged to acquaint the teaching staff with the submission against signature. After reviewing the submission, the teacher may, at his own discretion, submit to the certification commission additional information characterizing his professional activities for the period from the date of the previous certification (in the case of initial certification, from the date of entry to work) (clause 12 of Section II of the Procedure). If the employee refuses to familiarize himself with the submission, the employer, in the presence of at least two persons, draws up and signs a corresponding act.

The main form of certification is a meeting of the certification commission, which is considered valid if present at least two thirds of the total number of members of the certification commission. The teaching staff subject to certification must be present at the meeting. In case of absence for a good reason (must be documented and reflected in the minutes of the meeting), his certification is postponed to another date, and changes are made to the schedule, with which the employee must be familiarized no less than 30 calendar days before the date of new certification. If a teacher fails to appear without a valid reason, the organization’s certification commission has the right to conduct certification in his absence.

During the meeting, the certification commission reviews the submission and (if available) additional information characterizing the professional activities of the person being certified.

If this is provided for by the regulations of the certification commission, members of the certification commission exchange opinions, ask questions both to each other and to the teacher being certified, and, if necessary, make motivated proposals to consider additional information, etc.

Based on the results of consideration of the available information, the certification commission makes one of the following decisions (indicating the position of the certified pedagogical worker in the minutes of the meeting):

  • corresponds to the position held (when at least half of the members of the certification commission present voted for the decision on the suitability of the person being certified for the position held);
  • does not correspond to the position held.

“The decision is made by the certification commission of the organization in the absence of the teacher being certified by an open vote by a majority vote of the members of the certification commission of the organization present at the meeting.

When undergoing certification, a teaching worker who is a member of the organization’s certification commission does not participate in voting on his candidacy” (clause 16 of Section II of the Procedure).

The results of certification of teaching staff are entered into protocol, signed by all members of the certification commission and communicated to the person being certified immediately after the voting results are summed up. The protocol, along with other documents related to the certification of teaching staff, is kept by the employer. According to clause 20 of Section II of the Procedure for a teacher who has passed the certification, no later than two working days from the date of certification, the secretary of the organization’s certification commission draws up an extract from the protocol containing information about the last name, first name, patronymic (if any) of the person being certified, the name of his position, the date of the meeting of the organization’s certification commission, the voting results, and the decision made by the organization’s certification commission. The employer provides the teaching staff with an extract from the protocol against signature within three working days after its preparation. An extract from the protocol is kept in the personal file of the teacher.

Note!

Certification results in order to confirm the compliance of teaching staff with the positions they occupy based on the assessment and professional activities of the teaching staff has the right to appeal in accordance with the legislation of the Russian Federation (clause 21 of section II of the Procedure).

The results of the certification are the basis for the certification commission to submit, for consideration by the employer, motivated recommendations on the advisability (inexpediency) of appointing to the relevant positions of teaching staff persons who do not have special training and/or work experience, but at the same time have sufficient practical experience and competence to perform their assigned duties. their job duties are carried out efficiently and in full (clause 23 of section II of the Procedure).

Peculiarities of certification carried out in order to establish the qualification category for a teaching worker

Certification in order to establish a teaching worker’s qualification category is also carried out by a specially authorized body - the certification commission. But in this case, the commission is formed not by the employer (educational organization), but federal executive authorities or authorized state authorities of the constituent entities of the Russian Federation. It all depends on whose jurisdiction the relevant educational organizations are located (clause 25 of Section III of the Procedure). The principles for forming certification commissions are almost identical to those for conducting certifications in order to confirm compliance with the position held. In this case, the conditions for attracting specialists to carry out a comprehensive analysis of the professional activities of teaching staff are still being determined (clause 26 of Section III of the Procedure).

As noted, this type carries certification declarative nature— it is carried out on the basis of a written application from a teaching worker applying for a qualification category, which is submitted directly to the authorized certification commission. The employee can also send an application by regular mail (letter with acknowledgment of receipt) or by e-mail (with notification in the form of an electronic document). The application indicates the qualification categories and positions for which the teaching staff wishes to undergo certification (clauses 27, 28, section III of the Procedure).

“Applications for certification in order to establish the highest qualification category for the position for which certification will be carried out for the first time are submitted by the teaching staff no earlier than two years after the first qualification category has been established for this position. The expiration of the highest qualification category does not limit the right of a teaching worker to subsequently apply to the certification commission for certification in order to establish the highest qualification category for the same position. Applications from teaching staff for certification are considered by authorized certification commissions on time no more than 30 calendar days from the date of their receipt, during which:

a) a specific period for certification is determined for each teaching worker individually, taking into account the validity period of the previously established qualification category;

b) written notification of teaching staff is carried out about the date and place of their certification” (paragraphs 30 - 32 of section III of the order).

The duration of certification for each teaching worker from the beginning of its implementation until the decision is made by the certification commission cannot exceed 60 calendar days (clause 33 of Section III of the Procedure).

In light of the topic under consideration, let us pay attention to the basic criteria for establishing the first and highest qualification categories for teaching staff (clauses 36, 37 of Section III of the Procedure).

  • stable positive results students' mastery of educational programs based on the results of monitoring conducted by the organization;
  • stable positive results of students mastering educational programs based on the results of monitoring the education system, carried out in the manner established by Decree of the Government of the Russian Federation of 05.08.2013 No. 662 “On monitoring the education system”;
  • identifying the development of students’ abilities for scientific (intellectual), creative, physical education and sports activities;
  • personal contribution to improving the quality of education, improving teaching and educational methods, transmitting experience of practical results of their professional activities to teaching teams, active participation in the work of methodological associations of teaching staff of the organization.
  • students achieving positive dynamics in the results of mastering educational programs based on the results of monitoring conducted by the organization;
  • students achieving positive results in mastering educational programs based on the results of monitoring the education system, carried out in the manner established by Decree of the Government of the Russian Federation of August 5, 2013 No. 662 “On monitoring the education system”;
  • identifying and developing students’ abilities for scientific (intellectual), creative, physical education and sports activities, as well as their participation in olympiads, competitions, festivals, competitions;
  • personal contribution to improving the quality of education, improving teaching and educational methods and the productive use of new educational technologies, broadcasting the experience of the practical results of their professional activities, including experimental and innovative ones, to teaching teams;
  • active participation in the work of methodological associations of teaching staff of organizations, in the development of program and methodological support for the educational process, and professional competitions.

According to clause 35 of Section III of the Procedure, certification in order to establish a qualification category for a teaching worker can be carried out both in the presence of the person being certified, and without him, regardless of the reasons for absence.

The assessment of the professional activities of teaching staff in order to establish a qualification category is carried out by the certification commission based on the results of their work (according to the criteria for establishing the appropriate category), provided that their professional activities are actually related to the relevant areas of work (clause 38, section III of the Procedure).

Based on the certification results, the certification commission makes one of the following decisions (indicating the position of the certified teacher):

  • establish the first (highest) qualification category;
  • refuse to establish the first (highest) qualification category.

Final stage carrying out certification (up to the possibility of the certified person appealing its results) the same as in the case of certification to confirm compliance with the position held.

True, in contrast to the first type of certification, in this case the results of certification are made public: “based on decisions of certification commissions on the results of certification of teaching staff, the relevant federal executive authorities or authorized government bodies of the constituent entities of the Russian Federation issue administrative acts on the establishment of first or the highest qualification category from the date of the decision of the certification commission, which are posted on the official websites of the specified bodies on the Internet (clause 44 of section III of the Procedure).

3. Introduce the Procedure for certification of teaching staff of state and municipal educational institutions into force from January 1, 2011.

4. Application. The procedure for certification of teaching staff of state and municipal educational institutions

Application

I. General provisions

1. This Procedure for the certification of teaching staff of state and municipal educational institutions (hereinafter referred to as the Procedure) determines the rules for the certification of teaching staff of state and municipal educational institutions implementing basic educational programs of preschool, primary general, basic general, secondary (complete) general education, primary vocational and secondary vocational education, as well as additional educational programs (hereinafter, respectively, teaching staff, educational institutions, educational programs).

Pedagogical workers include persons occupying positions classified in the professional qualification group of teaching positions, approved by Order of the Ministry of Health and Social Development of the Russian Federation dated May 5, 2008 N 216n “On approval of professional qualification groups of positions of educational workers” (registered by the Ministry of Justice of the Russian Federation May 22, 2008, registration N 11731; Rossiyskaya Gazeta, 2008, N 113).

Certification of employees holding positions of scientific and pedagogical workers is carried out in accordance with the Regulations on the procedure for certification of employees holding positions of scientific and pedagogical workers, approved by order of the Ministry of Education and Science of the Russian Federation dated August 6, 2009 N 284 "On approval of the Regulations on the procedure for carrying out certification of employees holding positions of scientific and pedagogical workers" (registered by the Ministry of Justice of the Russian Federation on September 15, 2009, registration No. 14772, Bulletin of normative acts of federal executive bodies, 2009, No. 40).

2. Certification is carried out in order to establish compliance of the level of qualifications of teaching staff with the requirements for qualification categories (first or highest), or to confirm the compliance of teaching staff with the positions they occupy based on an assessment of their professional activities.

3. The main objectives of certification are:

stimulating targeted, continuous improvement of the level of qualifications of teaching staff, their methodological culture, personal professional growth, and their use of modern pedagogical technologies;

increasing the efficiency and quality of teaching work;

identifying prospects for using the potential capabilities of teaching staff;

taking into account the requirements of federal state educational standards for personnel conditions for the implementation of educational programs when forming the personnel of educational institutions;

determining the need to improve the qualifications of teaching staff;

ensuring differentiation of the level of remuneration for teaching staff.

4. The main principles of certification are collegiality, transparency, openness, ensuring an objective attitude towards teaching staff, and inadmissibility of discrimination during certification.

II. Formation of certification commissions, their composition and work procedure

5. Certification of teaching staff of educational institutions of a constituent entity of the Russian Federation and municipal educational institutions is carried out by an attestation commission formed by the executive body of the constituent entity of the Russian Federation exercising management in the field of education; certification of teaching staff of federal state educational institutions - by a certification commission formed by the federal executive authorities under whose jurisdiction they are (hereinafter referred to as the federal executive authorities).

6. The certification commission, consisting of the chairman of the commission, deputy chairman, secretary and members of the commission, is formed from among representatives of federal government bodies, government bodies of constituent entities of the Russian Federation, local governments, trade unions, scientific organizations and public associations, self-government bodies of educational institutions ( councils of educational institutions, boards of trustees, pedagogical councils etc.) and employees of educational institutions.

The personal composition of the certification commission is approved by an administrative act of the federal executive body, the executive body of the constituent entity of the Russian Federation that carries out management in the field of education.

To carry out certification in order to confirm the suitability of a teaching worker for the position held, a representative of the elected body of the corresponding primary trade union organization of the educational institution in which the given teaching worker works (another trade union representative authorized by the primary trade union organization of the educational institution) must be included in the certification commission.

7. To conduct certification in order to establish compliance of the level of qualifications of a teaching worker with the requirements for qualification categories (first or highest), the certification commission creates expert groups to carry out a comprehensive analysis of the results of the professional activity of a teaching worker and prepare an appropriate expert opinion for the certification commission.

8. The composition of the certification commission and expert groups is formed in such a way as to exclude the possibility of a conflict of interest that could affect the decisions made by the certification commissions.

9. A meeting of the certification commission is considered valid if at least two thirds of its members are present.

10. A teaching worker has the right to personally be present during his certification at a meeting of the certification commission, of which he notifies the certification commission in writing. If a teacher fails to appear at a meeting of the certification commission without a valid reason, the commission has the right to conduct certification in his absence.

11. The decision by the certification commission is made in the absence of the teacher being certified by open voting by a majority vote of the members of the certification commission present at the meeting. If there is an equal number of votes among members of the certification commission, it is considered that the teacher has passed the certification.

When undergoing certification, a teacher who is a member of the certification commission does not participate in voting on his candidacy.

The results of the certification of a teacher directly present at the meeting of the certification commission are communicated to him after the voting results are summed up.

12. The work schedules of certification commissions are approved annually by an administrative act of the federal executive body, the executive body of the constituent entity of the Russian Federation exercising management in the field of education.

13. The decision of the certification commission is documented in a protocol, which comes into force from the date of signing by the chairman, deputy chairman, secretary and members of the certification commission who took part in the voting, and is entered into the certification sheet of the teaching worker.

In the certification sheet of a teaching worker, if necessary, the certification commission enters recommendations on improving the professional activity of a teaching worker, on the need to improve his qualifications, indicating his specialization, and other recommendations.

If the certification sheet contains the specified recommendations, the employer, no later than one year from the date of certification of the teaching worker, submits to the certification commission information on the implementation of the recommendations of the certification commission on improving the professional activities of the teaching worker.

14. The decision of the certification commission on the results of certification of teaching staff is approved by an administrative act of the federal executive body, the executive body of the constituent entity of the Russian Federation exercising management in the field of education. For teaching staff in respect of whom the certification commission has decided that their level of qualifications meets the requirements for the first (highest) qualification category, the corresponding qualification category is established by the specified administrative act.

15. The certification sheet and an extract from the administrative act of the federal executive body, the executive body of the constituent entity of the Russian Federation exercising management in the field of education, are sent to the teacher’s employer no later than 30 calendar days from the date of the decision of the certification commission for the employee to familiarize themselves with them under registration and decision-making in accordance with the Labor Code of the Russian Federation.

The certification sheet, an extract from the administrative act of the federal executive body, the executive body of the constituent entity of the Russian Federation that carries out management in the field of education, are stored in the personal file of the teacher.

16. A teaching worker has the right to appeal the results of certification in accordance with the legislation of the Russian Federation.

III. The procedure for certification of teaching staff in order to confirm compliance with the position held

17. Certification in order to confirm the suitability of teaching staff for the position held is carried out once every 5 years in relation to teaching staff who do not have qualification categories (first or highest).

18. The following are not subject to certification:

teaching staff who have worked in their position for less than two years;

pregnant women; women on maternity leave; teaching staff who are on parental leave until the child reaches the age of three. Certification of these employees is possible no earlier than two years after their return from the specified vacations.

19. The basis for certification is the employer’s submission (hereinafter referred to as the submission).

20. The submission must contain a motivated, comprehensive and objective assessment of the professional, business qualities of the teaching staff, the results of his professional activities based on the qualification characteristics for the position held, information about the teaching staff’s advanced training, including in the direction of the employer, for the period preceding the certification, information about the results of previous certifications.

The teacher must be familiarized with the submission by the employer against signature no later than a month before the date of certification. After reviewing the submission, the teacher has the right to submit to the certification commission his own information characterizing him labor activity for the period from the date of the previous certification (in case of initial certification - from the date of entry into work), as well as a statement with appropriate justification in case of disagreement with the employer’s representation.

21. Information about the date, place and time of certification is brought to the attention of teaching staff subject to certification in writing by the employer no later than a month before it begins.

22. During certification, teaching staff undergo qualification tests in writing on issues related to their teaching activities in their position.

23. Based on the results of certification of a teaching employee in order to confirm compliance with the position held, the certification commission makes one of the following decisions:

corresponds to the position held (the position of the employee is indicated);

does not correspond to the position held (the employee’s position is indicated).

24. If, based on the results of certification, a teaching worker is recognized as inappropriate for the position held due to insufficient qualifications, the employment contract with him may be terminated in accordance with paragraph 3 of part 1 of Article 81 of the Labor Code of the Russian Federation. Dismissal on this basis is permitted if it is impossible to transfer a teaching employee with his written consent to another job available to the employer (both a vacant position or work corresponding to the employee’s qualifications, and a vacant lower position or lower-paid job), which the employee can perform taking into account his condition health (Part 3 of Article 81 of the Labor Code of the Russian Federation).

IV. The procedure for certification of teaching staff to establish compliance of their level of qualifications with the requirements for qualification categories (first or highest)

25. Certification of a teaching worker to establish compliance of his level of qualifications with the requirements for the first or highest qualification categories is carried out on the basis of an application from the teaching worker.

The application of a teacher for certification must be considered by the certification commission no later than one month from the date of submission.

26. The timing of certification for each teaching worker is established by the certification commission individually in accordance with the schedule. When drawing up the schedule, the validity periods of previously established qualification categories must be taken into account.

27. The duration of certification for each teaching worker from the beginning of its implementation until the decision of the certification commission is made should not exceed two months.

28. The qualification category for teaching staff established on the basis of certification is valid for five years.

29. Teaching staff may apply to the certification commission for certification to establish compliance of their level of qualifications with the requirements for the highest qualification category, no earlier than 2 years after the establishment of the first qualification category.

30. The first qualification category may be established for teaching staff who:



make a personal contribution to improving the quality of education based on improving teaching and educational methods;

have stable results in the development of educational programs by students and pupils and indicators of the dynamics of their achievements are above average in the constituent entity of the Russian Federation.

31. The highest qualification category may be established for teaching staff who:

have the established first qualification category;

master modern educational technologies and methods and effectively apply them in practical professional activities;

have stable results in the development of educational programs by students and pupils and indicators of the dynamics of their achievements are above average in the constituent entity of the Russian Federation, including taking into account the results of participation of students and pupils in all-Russian and international olympiads, competitions, competitions;

make a personal contribution to improving the quality of education based on improving teaching and upbringing methods, innovative activities, in the development of new educational technologies and actively disseminate their own experience in the field of improving the quality of education and upbringing.

32. Based on the results of the certification, the certification commission makes one of the following decisions:

a) the level of qualification (position indicated) meets the requirements for the first (highest) qualification category;

33. When the certification commission makes a decision on the non-compliance of the qualification level of a teaching worker with the requirements for the highest qualification category, he retains the first qualification category until the end of its validity period.

34. Qualification categories are preserved when a teaching worker moves to another educational institution, including one located in another constituent entity of the Russian Federation, during its validity period.

In accordance with part 4 of article 49 Federal Law of December 29, 2012 N 273-FZ “On Education in the Russian Federation” (Collected Legislation of the Russian Federation, 2012, N 53, Art. 7598; 2013, N 19, Art. 2326; N 23, Art. 2878; N 27, Art. 3462; N 30, Art. 4036; N 48, Art. 6165; 2014, N 6, Art. 562, Art. 566) and subclause 5.2.28 Regulations on the Ministry of Education and Science of the Russian Federation, approved resolution Government of the Russian Federation dated June 3, 2013 N 466 (Collected Legislation of the Russian Federation, 2013, N 23, Art. 2923; N 33, Art. 4386; N 37, Art. 4702; 2014, N 2, Art. 126; N 6, Article 582) I order:

1. Approve in agreement with the Ministry of Labor and social protection Russian Federation attached Order carrying out certification of teaching staff of organizations carrying out educational activities.

2. Establish that the qualification categories established for teaching staff of state and municipal educational institutions before approval About specified in paragraph 1 of this order are preserved for the period for which they were established.

3. Declare invalid order Ministry of Education and Science of the Russian Federation dated March 24, 2010 N 209 “On the Procedure for Certification of Teaching Workers of State and Municipal Educational Institutions” (registered by the Ministry of Justice of the Russian Federation on April 26, 2010, registration N 16999).

Installed new order certification of teaching staff of educational organizations. It does not apply to the teaching staff.

All teaching staff, including part-time teachers, are subject to certification.

Certification commissions, in order to confirm the suitability of employees for their positions, are now independently formed by educational organizations. The frequency of certification has not changed - once every 5 years. At the same time, employees who were absent from work due to illness for more than 4 months in a row are certified no earlier than a year after returning to work.

Qualification categories (first or highest) are established for teaching staff at their request. Employees who have a qualification category do not undergo certification in order to confirm their suitability for the position held.

An application for assignment of a category can be submitted by mail or electronically. It can also be submitted while on parental leave.

The grounds for assigning qualification categories have been clarified. If the category is refused, the employee can re-apply for its assignment only after a year.

Previously assigned qualification categories are retained for the period for which they were established.
