Russian family law provides for the possibility of divorce either by mutual consent or at the request of only one of the spouses.
Divorce in unilaterally arises for various reasons - the physical impossibility of the defendant to appear in court, an obstacle to the process, or other life circumstances.
Either spouse has the right to initiate the termination of the marriage.
Unilateral divorce occurs when:
- the second spouse does not come to divorce proceedings;
- partner refuses to divorce.
The initiator of the divorce can submit an application to the registry office or file a claim in court, it all depends on additional circumstances.
Divorce through the registry office unilaterally, when possible
You can get a divorce at the registry office only if certain requirements are met.
Firstly, husband and wife should not have young children and disputes over property.
Secondly, mutual consent of the parties is required.
The procedure for divorce through the registry office can be completed without the presence of the second partner; to do this, you need to provide to the registry office a notarized statement of intention to dissolve the marriage.
The law allows divorce through the registry office at the request of only one person based on the following reasons:
- The second husband went missing and this was established in court.
- Loss of legal capacity.
- Serving a sentence (prison term - at least 3 years).
It is simply impossible to receive a positive answer to a divorce from a missing or incapacitated person, and imprisonment due to a crime frees the other partner from the need to obtain such consent.
Unilateral divorce through court
If it is not possible to carry out the procedure through the registry office, then the initiator will have to file a claim.
First, you need to file an application with the court, indicating the reason for the unilateral divorce, attaching supporting documents to the claim.
Which court to file a claim in?
The claim for dissolution of the marriage union is filed at the place of residence of the defendant.
If the spouses live in the same city, filing such a claim is not difficult.
But what to do if the defendant lives in another locality.
There are not many reasons to file a claim in court at the plaintiff’s place of residence:
- disease;
- the presence of minor children living with the plaintiff.
It is imperative to take into account the jurisdiction, since you can make a mistake and the application will not be accepted.
You need to submit an application:
- to the magistrate - when it comes only to disagreement with the divorce;
- district judge - if there are young children or the division of common property is being carried out.
Procedure for filing a claim in court for unilateral divorce
The process of divorce through the court does not require preliminary stages - such as concluding an agreement, etc.
If the couple cannot reach an agreement, they need to go to court.
When the spouses have reached an agreement on certain issues, they can draw up an agreement (for example, on alimony or the place of residence of children), which must then be attached to the claim to confirm the fact of agreement on a specific issue.
The procedure for divorce through court in Russia:
- Prepare documents for subsequent submission to the court. You can invite a lawyer to draw up a claim. He can also represent his client's interests during the trial.
- Next, you should choose a court and file a claim.
- Receive notification of the meeting date.
- Appear in court on the designated date.
- Wait for the court ruling to come into force.
- Go to the registry office and pick up a certificate of dissolution of the family union.
Important! Payment of the state fee is mandatory.
The divorce process through the court has a number of rules.
The more disputes between spouses, the more likely it is that the court will take longer to make a decision.
If, as part of the trial, questions about the place of residence of a minor child and the collection of alimony will be considered, then a representative of the guardianship authority must be present at the meeting.
The failure of one of the participants in the proceedings to appear will lead to a delay in the process, as the meeting will be postponed.
The law does not prohibit making a decision in absentia if circumstances are revealed in which the defendant deliberately ignored to appear in court or did not accept the summons in order to delay the proceedings.
If a person does not report the existence of a serious reason for absence, failing to appear at the hearing three times, the court has the right to make a decision without him.
If the plaintiff or defendant had important circumstances for which he did not appear in court, and he can confirm this fact, the court decision can be appealed.
If the defendant files a motion for reconciliation, the court does not have the right to refuse it. A period of no more than 1 month is allowed for reconciliation.
If, after the reconciliation period, the couple is unable to improve their relationship, the court will grant the claim for divorce.
The plaintiff can appeal the court decision within one month if he does not agree with it.
As soon as the decision on the claim comes into force, a copy of it must be sent to the registry office where the spouses entered into their marriage. There they can, after paying a fee, receive a certificate confirming the dissolution of the marriage. Everyone gets their own original.
List of documents
An important condition for any divorce is the availability of the necessary documents.
The statement of claim is prepared in three copies:
- the first - the plaintiff keeps it, having previously put a corresponding mark on the document in the court office;
- the second is sent to the defendant;
- the third is filed with the court case.
In addition to the statement of claim, the plaintiff must provide:
- Documents confirming the identity of the applicant and the respondent (original and copy of passport).
- Receipt for payment of state duty.
- Certificate of marriage.
- A copy of the child(ren)'s birth certificate.
- Papers confirming ownership of the apartment, etc.
- Certificate of income.
- Additional documents. This could be an alimony agreement, a marriage contract, etc.
When a unilateral divorce is carried out at the registry office, you must provide:
- application for divorce of the established form;
- passport;
- certificate of marriage;
- a notarized statement of the consent of the second partner to dissolve the marriage.

It is better to entrust the preparation of the necessary papers to a qualified lawyer, especially if the couple has property disputes.
The law does not prohibit filing a claim on your own. It is important to take into account the norms of civil law.

State duty, cost of unilateral divorce procedure
The cost of unilateral divorce proceedings depends on the purpose of the claim.
⇒ If the plaintiff initiates divorce proceedings due to the fact that the defendant is incompetent or missing, then the state duty will be 350 rubles.
⇒In case divorce through the registry office by mutual consent, both spouses must pay a fee in the amount 650 rubles.
⇒When going to court- the amount of state duty for the plaintiff will be 600 rubles, but only when the claim does not contain a clause on division of property.
If a couple, in addition to a divorce, wants to settle issues with the division of jointly acquired property, then the final price of the claim depends on the value of the living space of the apartment or house, car and other expensive assets. The maximum amount of state duty cannot exceed 60 thousand rubles.
A receipt confirming payment of the tax must be attached to the remaining documents.
Besides, upon completion of the trial ex-spouses must additionally pay a state fee in the amount 650 rubles for each, for making changes to the relevant registers, and issuing a divorce certificate.
Involving a lawyer or advocate in the trial will entail additional costs for their services:
- preliminary consultation will cost at least 1–2 thousand rubles;
- filing a claim – about 5 thousand rubles;
- representation of interests in court – from 15 thousand rubles.
If you lose your case in court, you can, of course, file an appeal, but it’s much better to think through your strategy in advance.
How long to wait for an official divorce
The timing of divorce is always individual. The method of divorce, the possibility of appealing a court decision, etc. should be taken into account.
For example, if the second participant in the divorce proceedings does not appear at the hearings or files a petition for reconciliation, the procedure may be significantly delayed.
But on average, court proceedings on these issues last no more than 3 months. The law gives thirty days to consider a claim, and another month to hold a meeting. Once a court order is issued, it comes into force only after 30 days.
In case of unilateral termination through the registry office, the procedure takes 1 month.
When can a unilateral divorce be refused?
There are legal grounds when dissolution of a marriage without a positive response from the partner is simply impossible:
- if the wife is pregnant;
- There is joint child, under one year of age (12 months).
The claim will be denied if the above circumstances exist and the spouse is against the divorce.
If the initiator of the divorce is the spouse, then the court may not take into account all these circumstances when making a decision.
These reasons are temporary, but limit a man from initiating divorce proceedings. However, the plaintiff may make a similar request again after the common child reaches 1 year of age. Then the place of residence of the minor will be determined, the procedure for providing alimony will be determined, and the spouses will be divorced according to the standard procedure.
Is it possible to stop the divorce process?
According to the law, the plaintiff has the right to renounce his claims at any stage of the trial (Articles 39, 173 of the Code of Civil Procedure of the Russian Federation).
But refusal is accompanied by compliance with certain conditions:
- it must not violate the rights and interests of third parties;
- must be provided before the court order is issued.
Waiver of claims automatically means that the spouses’ marriage remains valid.
But the plaintiff has the right to apply for divorce again if the circumstances due to which the refusal was received have changed over time.
How to file a unilateral divorce online
You cannot get a divorce over the Internet; you can only submit documents to carry out this procedure. The law does not yet allow filing a claim through State Services; documents must be presented to the registry office.

The wife’s second condition seemed stupid to me: she wanted me to carry her out of the bedroom every morning for a month in my arms and carry her to the porch, as a reminder of how after the wedding I brought her into my home.
I didn't argue, I didn't care. At work, I mentioned this request to Jane, to which she sarcastically noted that this was my wife’s pathetic attempt to manipulate me into returning me to the family.
